GENERAL TERMS AND CONDITIONS

The New Zealand Consumer Guarantees Act (1993) as well as other laws in the jurisdiction guarantee certain conditions, warranties and undertakings, and give you other legal rights, in relation to the quality and fitness for purpose of Bow Mirrors consumer products sold in New Zealand. For products sold in New Zealand, these guarantees cannot be modified nor excluded by any contract, except in those circumstances contemplated by section 43 (2) of the New Zealand Consumer Guarantees Act. You are entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality. You are also entitled to a replacement or refund for a major failure of the goods and compensation for any other reasonably foreseeable loss or damage. What constitutes a major failure is an objective test of reasonableness and not necessarily an individual consumer’s point of view. Nothing in this Warranty purports to modify or exclude the conditions, warranties and undertakings, and other legal rights, under the New Zealand Consumer Guarantees Act and other laws. This Warranty gives you additional protection for your Bow Mirrors consumer product, and identifies a preferred approach to resolving warranty claims which will be quickest and simplest for all parties, subject to the exclusions, terms and conditions below.

I. Coverage and Application

Bow Mirrors Limited, of 45 Western Springs, Auckland warrants that your Bow Mirrors consumer product:

  • is of acceptable quality;
  • does not have a latent defect.

For the purpose of this Warranty, a "Bow Mirrors consumer product" is a product which:

  • was manufactured by or on behalf of Bow Mirrors; and
  • is used in a normal domestic environment (unless otherwise agreed prior with Bow Mirrors); and
  • was sold by an Authorised Distributor of Bow Mirrors

II. Warranty Period

The period during which this Warranty is in effect will depend upon the Bow Mirrors product to which it relates. The products and relative warranty periods are as follows:

  • Frameless arch mirror: 90 days.
  • Premium pine base: This product is not covered under warranty.
  • Installation (please see our installation disclaimer statement in section VII): 90 days.
  • Rentals: Limited to the rental period specified in the rental agreement.

III. Warranty Claim

If you consider that the Bow Mirrors consumer product which you have purchased is not of acceptable quality, has a latent defect, or is otherwise not compliant with the conditions, warranties, undertakings, and legal rights given to you under New Zealand Law (for example, it appears faulty, or does not work at all or properly), you can make a claim under this Warranty. Warranty claims are limited to New Zealand only.

If you purchased this product in New Zealand and wish to make a claim under this Warranty, you should:

When you make any claim under this Warranty it is essential that you provide a copy of your proof of purchase of the Bow Mirrors product, whether in person or by email. A claim under this Warranty is not formally made unless and until that proof of purchase is provided. This does not detract from your statutory rights.

You will not be able to gain the benefit of this Warranty without making a claim. A claim must be made within the Warranty Period. This Warranty does not cover any defects not notified to Bow Mirrors within the Warranty Period, although you may have statutory rights outside of the Warranty Period.

If, following receipt of a claim under this Warranty, Bow Mirrors or its agent determine that your claim in respect of a Bow Mirrors product is valid (having regard to the terms of Part II of this Warranty), and if the goods can be repaired and the failure to comply with the warranty is not a major failure or a failure of substantial character, Bow Mirrors or its agent will replace the Bow Mirrors product with the same or similar product or refund you the cost of a replacement, in each case depending upon what is reasonable in the circumstances and with regard to Bow Mirrors’ statutory obligations and at no cost to you.

The standard Bow Mirrors warranty periods are set out by product type in Part II of this Warranty, although each claim is assessed on its own merits and you may have statutory rights outside of the Warranty Period. If Bow Mirrors provides you with either a replacement or refund, you immediately transfer ownership of the original Bow Mirrors product or part to Bow Mirrors.

Any such resolution by Bow Mirrors of a claim under this Warranty by you does not otherwise detract from any other statutory rights which you might have in the circumstances, including your right to monetary compensation for a valid claim.

If, following receipt of a claim under this Warranty, Bow Mirrors or its agent determine that your claim in respect of a Bow Mirrors product is invalid, Bow Mirrors may charge you for any labour, parts or transport costs incurred by Bow Mirrors or its agent in assessing your claim.

IV. Warranty Transferability

This Warranty is not transferable to a subsequent owner of a Bow Mirrors consumer product.

V. Remediation of the claim

If you wish to make a claim in relation to a Bow Mirrors product, please contact Bow Mirrors via the phone number or email address listed in section I of this warranty.

If you are personally transporting the Bow Mirrors product to Bow Mirrors’ registered business address, whenever possible, the product should be returned in its original carton and packing or alternatively in packing suitable to prevent damage to the product Bow Mirrors will not accept responsibility for damage to the product during this transport caused by unsuitable or inadequate packing.

If you believe that it is not reasonable for you to bring the Bow Mirrors product to Bow Mirrors registered business address, a Bow Mirrors representative will arrange collection at no cost to you if your claim is determined to be valid pursuant of Part I of this warranty.

VI. Warranty exclusions

This section identifies what is excluded under this Warranty. For the avoidance of any doubt, any and all warranties or conditions which are not guaranteed under the New Zealand Consumer Guarantees Act (as applicable) and which are not expressly included in this Warranty as additional warranties or conditions are excluded.

This Warranty does not extend to loss caused by normal wear and tear, fire, water theft, vermin or insect infestation.

This Warranty does not cover any damaged or defective goods which have been installed or associated costs with installed damaged or defective goods, such as removal, electrical costs.

Goods must be inspected prior to installation and not installed if defective.

If you are purchasing our product for use in a commercial space (commercial spaces referring to activities carried out on property developed for industry, commerce, trade, recreation, or business or being developed to be occupied for such purposes), you are responsible for complying with your industry’s relevant safety standards.  

Any mirrors installed within sea spray zone D / Coastal areas with high risk of wind-blown sea-spray salt deposits defined as “includes all areas within 500 m of the coast including harbours, 100 m from tidal estuaries and sheltered inlets, all offshore islands”. Mirrors installed outside including mirrors under shelter.

This Warranty does not cover damage caused by:

  • misuse or abusive use of the Bow Mirrors product, including physical abuse, personal handling, or installation of goods
  • damage caused by normal wear and tear
  • spontaneous or otherwise unknown breakages.
  • incorrect operation
  • improper installation;
  • incorrect or improper maintenance or failure to maintain the Bow Mirrors & product;
  • failure to clean or improper cleaning of the product;
  • glass or chemical cleaners;
  • adverse external conditions such as acts of God, acts of terrorism, damage caused by vermin, or any other act or circumstance beyond Bow Mirrors’ control;
  • exposure to excessive heat, moisture or dampness;
  • water damage;
  • exposure to abnormally corrosive conditions;
  • use of non-authorised/non-standard, defective or incompatible parts;
  • repair, modification or other work carried out on the Bow Mirrors product other than by Bow Mirrors staff or an approved repair Person nominated by Bow Mirrors.
  • damages caused during transport of a Bow Mirrors product when transport is not carried out by Bow Mirrors staff.

This Warranty does not cover service costs in replacing and maintaining consumable parts which have ceased working through normal wear and tear.

VII. Installation Disclaimer 

Bow Mirrors provides this disclaimer to outline the terms and conditions of mirror installation services:

  1. Professional Installation: Installations are performed by a New Zealand qualified builder. This individual will perform the mirror installation using appropriate methods and techniques to ensure proper mounting and stability.
  1. Client Cooperation: The client agrees to provide access to the installation site and ensure that the designated area is clear and suitable for installation prior to our arrival.
  1. Liability Waiver: While every effort is made to install the mirror securely and safely, Bow Mirrors shall not be held liable for any damages, injuries, or losses resulting from unforeseen circumstances, including but not limited to structural deficiencies, improper wall conditions, or client interference during installation. Bow Mirrors shall not be held liable for any damages, injuries, or losses resulting from misuse or neglect of mirrors. Users assume all risks associated with the installation and use of mirrors.
  1. Warranty Limitations: Our installation services come with a limited warranty (specified in section II) covering workmanship defects. However, this warranty does not cover damages resulting from misuse, accidents, or alterations made to the installed mirror after our service completion.
  1. Client Responsibilities: The client is responsible for inspecting the installed mirror upon completion and notifying Bow Mirrors of any concerns or issues within a reasonable timeframe. Failure to report any discrepancies may void the warranty.
  1. Additional Services: Any additional services requested by the client beyond the scope of the initial agreement may incur extra charges, subject to mutual agreement between Bow Mirrors and the client. 
  1. Alternate Installation Methods: If the client chooses to install the mirror themselves, or make adjustments to the installation completed by Bow Mirrors, they do so at their own risk. Bow Mirrors shall not be held liable for any damages, injuries, or losses resulting from the client installing the mirror themselves.

By proceeding with the mirror installation service provided by Bow Mirrors, the client acknowledges that they have read and understood this disclaimer, and they agree to abide by its terms and conditions.

VIII. Rental Disclaimer

Thank you for choosing our mirrors for your event. Please read the following disclaimer carefully before proceeding:

  1. Handling and Installation: Our mirrors are delicate and should be handled with care. Our experienced team will deliver, set up, and collect your mirror(s). Bow Mirrors are not liable for any damages or accidents caused should you handle the mirror(s).

  2. Safety Precautions: Please exercise caution to prevent accidents. Our team will consult with you regarding appropriate placement and/or installation of the mirror(s) however we recommend you keep them away from high-traffic areas and where they may be subjected to excessive force (human, natural, or otherwise). Bow Mirrors are not liable for any damages or accidents caused if the instructions for use set out by Bow Mirrors are not followed.

  3. Liability: Bow Mirrors are not liable for any accidents, injuries, or damages resulting from misuse of our mirrors during your event. Clients assume full responsibility for the safety and well-being of their guests and property.

  4. Return Policy: Please inspect the mirrors upon delivery and notify us immediately of any damages or issues. Refunds or replacements will be provided according to our rental agreement terms. 

By proceeding with the rental, clients acknowledge that they have read, understood, and agreed to abide by the terms of this disclaimer. If you have any questions or concerns, please don't hesitate to contact Bow Mirrors via the details listed in section I. 

IX. Rental Agreement (template only for the purpose of reviewing terms)

This agreement is entered into between Bow Mirrors and The Client (client name) for the rental of mirror(s) for the event specified below:

Mirror(s) specifications: 

  1. Rental Period: The rental period shall commence on [start date] and terminate on [end date]. The mirror(s) shall be delivered to the event location and picked up by the Bow Mirrors’ representative at the conclusion of the rental period. A late collection fee may be applied if The Client is unable to facilitate accessibility to the venue.
  1. Rental Fee: The Client agrees to pay the rental fee for the mirror(s) as specified in the invoice provided by Bow Mirrors. Payment is due 7 days prior to the event date.
  1. Delivery and Setup: Bow Mirrors will deliver and set up the mirror(s) at the event location at the agreed-upon time. The Client shall ensure accessibility to the venue.
  1. Care and Maintenance: The Client agrees to handle the mirror(s) with care and shall not attempt to disassemble, modify, or relocate the mirror(s) without prior approval from Bow Mirrors. Any damages incurred during the rental period shall be the responsibility of The Client.
  1. Liability: The Client assumes full responsibility for the safe use and supervision of the mirrors during the event. Bow Mirrors shall not be liable for any accidents, injuries, or damages arising from misuse of the mirror(s).
  1. Cancellation Policy: Cancellation of the rental booking must be made in writing at least 7 days prior to the event date. Cancellations made after this period may result in forfeiture of the rental fee.
  1. Return and Refund Policy: Please inspect the mirrors upon delivery and notify us immediately of any damages or issues. We recommend delivery 24 hours prior to the commencement of your event to ensure adequate time for replacement and/or repairs to be arranged. Alternatively, you may request a full refund (at which time the mirror will be removed from the event site). Bow Mirrors cannot guarantee arrangement of replacement and/or repairs with under 24 hours’ notice. Subsequently this may impact The Client’s eligibility for a full refund.

  2. Bond: The client agrees to pay the bond amount as specified in the invoice provided by Bow Mirrors. Payment is required 7 days prior to the event date. Fees associated with damages that have occurred in breach of the rental disclaimer and rental agreement may result in full or partial forfeiture of the bond amount.
